1) Family Law

Family law is an area of law that includes each person's rights, obligations and legally available remedies for resolution of conflicts created giving rise to disputed issues concerning marriage and divorce, custody rights of unwed parents (paternity), domestic partnerships (same sex couples), child custody, visitation, child support, spousal support, division of assets, debts, retirements, civil and military pension benefits, disability, federal and state tax liabilities, payment of attorney fees, disposition of family residence, and ownership of business interests, as well as specialized matters such as adoption, abduction, kidnapping, child abuse, restraining orders, domestic violence, enforcement and everything else covered within the California Family Code.


2) Spousal Support

Spousal support, formerly called alimony, is a court order that requires one spouse to pay a specific amount of money to the other spouse. State law governs the amount and duration that a court may compel a party to provide spousal support to the other party. The factors used by a court for a legal determination of temporary spousal support (prior to entry of Judgment) and permanent support (after Judgment has been granted) are quite different. On application of either party for spousal support, the court may decide to increase or decrease the amount to be paid, but only upon a showing that there has been a substantial and material change of circumstances to justify an order changing the original award of support. Except in rare cases, spousal support will terminate upon death of either party or when the recipient re-marries. Courts may also reduce spousal support payments down to zero if it finds such an order is needed to avoid a harsh and inequitable result. The Court may award permanent or temporary support to a man or woman, considering the following factors:
The actual need;
Ability to pay;
The duration of the marriage;
The age of the parties;
The physical health of the parties;
The emotional health of the parties;
The standard of living established in the marriage and the likelihood that each party can maintain a reasonably comparable standard of living;
The earning capacities of the parties;
The educational levels of the parties;
The vocational skills of the parties;
The employability of the parties;
The amount of time a party has been absent from the job market;
The custodial responsibilities for minor children of the party seeking spousal support;
The time and expense needed by a party to acquire a sufficient education or training to enable a party to become employed, and the availability of training and employment.
The opportunity for future acquisitions of capital assets and income;
The history of the non-financial contributions to the marriage by each party including contributions to the care and education of the children and interruption of personal careers or educational opportunities;
The history of the financial contributions to the marriage by each party including contributions to the care and education of the children and interruption of personal careers or educational opportunities;
The equitable distribution of property ordered and any payouts on equitable distribution, directly or indirectly, out of current income, to the extent this consideration is reasonable, just and fair; and
Any other factors which the court may deem relevant.

A divorce decree establishes the new relations between the parties, including their duties and obligations relating to property that they own, support responsibilities of either or both of them, and provisions for any children.When a marriage breaks up, divorce law provides legal solutions for issues that the Husband and Wife are unable to resolve through mutual cooperation. Historically, the most important question in a divorce case was whether the court should grant a divorce. When a divorce was granted, the resolution of continuing obligations was simple: The wife was awarded custody of any children, and the husband was required to support the wife and children.

Modern divorce laws have inverted the involvement of courts. The issue of whether a divorce should be granted is now generally decided by one or both of the spouses. Contemporary courts are more involved in determining the legal ramifications of the marriage breakup, such as spousal maintenance, child support, and child custody. Other legal issues relating to divorce include court jurisdiction, antenuptial and postnuptial agreements, and the right to obtain a divorce. State laws govern a wide range of divorce issues, but district, county, and family courts are given broad discretion in fixing legal obligations between the parties.

Divorce is a difficult life challenge convoluted by a legal process that is largely unknown to us as we attempt to navigate a path to our desired goal - the dissolution of marriage. Due to this convoluted system, it leaves us not knowing what we don't know, so we seek good counsel and expect certain results. Thankfully, I sought the help of Attorney Richard Freed and, due to his exceptional counsel, survived an extremely difficult journey along the tumultuous and chaotic road to divorce. Unfortunately for me, my ex-wife sought guidance from the most greedy and unethical attorney imaginable, attempting to take everything she could at each turn, to include precious time with my son, with the vengeful intent to harm me for finally having the guts to leave our failed marriage after years of co-habitation and misery. It was a battle unlike anything I've ever experienced (and I’ve been through a lot). Along the way, I had to fire two previously retained attorneys who were incapable of handling my case, who had wasted thousands of my dollars and precious time, and who accomplished little of substance in the previous year prior to my discovery of Mr. Freed. During the first meeting with Richard, I knew he was extremely capable and the attorney who could get the divorce finalized ethically, timely and ensure an equitable settlement for all parties, per California family law. From the beginning, he was professional, knowledgeable, experienced, extremely capable, and unlike the others, genuinely cared about helping me through the process, promising to “get it done.” Further, Richard was extremely helpful with child custody matters, where his experience in this field was of tremendous value and really showed. He provided recommendations for child counseling and guidance that helped me navigate the difficult challenges I was facing in dealing with my previously mandated visitation schedule that, up to this point, was being frustrated by my ex-wife at every opportunity. Worse, my son was being manipulated and the frustration of the visitation schedule was causing tremendous strain in my relationship with him. According to Mr. Freed, my case and the people involved were unlike anything he had seen in 27 years. Immediately, he drafted a clear path forward knowing the level of stress I was under and the much-needed help I was desperately seeking, making the personal commitment to see this through to the end. Opposing counsel constantly tried to delay the process, as had been the pattern for months, churning out countless hours for personal gain. Yet, because of his perseverance and expertise, Richard managed to finalize a Marriage Settlement Agreement (MSA) in just six months, in spite of the opposing side not negotiating in good faith and purposely causing delays, my ex-wife avoiding meetings and phone calls, the opposing attorney freezing assets without justification and continuously sending threatening letters to muddy the legal waters and increase billable hours, along with other unethical behavior too lengthy to explain. As the MSA was being finalized, I again saw how invaluable Richard was and the command he had for family law, especially in comparison to the opposing counsel. For example, my ex-wife’s attorney was confused about very simple items in Mr. Freed’s draft settlement agreement and demanded that language be omitted or changed that is basic to all MSAs. Richard painfully guided the settlement process along while exhibiting an impressive depth of knowledge in all areas, especially in that of child custody. Additionally, and equally as important, he was well versed in the financial aspects of the division of marital assets, including taxation, domestic resolution orders, real estate, income and expense declarations, and monthly support estimations. Without doubt, if it weren't for Mr. Freed’s exceptional counsel, I would still be shackled to a horrible woman who tried her best to ruin me. I will forever be indebted to Richard for his counsel and guidance, and certainly can’t thank him enough for all his hard work, perseverance, and dedication. Hiring him was one of the smartest decisions I've ever made.

My divorce was ugly, plain and simple. I married a bully and was a victim of domestic violence. His language nuanced, firm, and teased out the critical details that revealed the truth behind the lies of my ex and all her witnesses. Mr. Freed is a BOSS in the courtroom. I was involved in a very contentious child custody case. My ex came from a family of lawyers and she retained one of the best, most experienced, well connected lawyers in all of S. California. Having never been in the courtroom before, I became a nervous wreck and started having anxiety attacks which only further hurt my case. I know Richard Freed because he represented me in my family law case. Not only is Mr. Freed a winner and win we did he does so in a very elegant fashion. I thought I was watching Tom Hanks in a few good men. His words are conducted in a manner that other attorney's are not equipped to handle. His arguments are very persuasive and as a law student it was a joy being able to watch such a beast in court.
